2. Conditions of use of the website

Any access to the website and / or any research carried out on said site, and / or any use of said site by the user implies acceptance of the Conditions of Use of the website, as defined below. These conditions of use may be modified or adjusted at any time; therefore the website users are invited to consult them on a regular basis.
Anyone can access to this site at any time. However, Mr François MARTHAN may decide to interrupt the service for technical maintenance. In such case, he will communicate in advance to the users the schedule of maintenance works.
The website is frequently updated by Mr François MARTHAN. Similarly, the legal notice may be modified at any time: Nevertheless, it imposes to the user who is invited to refer to it as frequently as possible.

3. Purpose of the website

The purpose of the website is to provide some information about the activities of the company.
SINADEO endeavors to provide reliable content. However, it is not liable for omissions, inaccuracy and lacks in updates, being the owner of the information or the user of the third-party partners information.
All contents in the website is only made available to users for information and is likely to change over time. Furthermore, the information appearing in the site is not exhaustive. It is provided subject to modification being applied from its release online.

4. Legal restrictions on technical data

The website uses the JavaScript technology.
The internet website is not liable for any hardware damages associated with the use of the site. Furthermore, the user of the site commits to access to the site by using a recent equipment, free from virus and thanks to a latest generation up-to-date web browser.

5. Intellectual property rights

SINADEO is the owner of the intellectual property rights or holds the right to use all elements accessible from the site, including, in particular, texts, images, graphics, logos, icons, sounds, software.
Any copy, representation, modification, publishing, adaptation of all or part of the website elements, regardless of the mean or process used, is prohibited without prior consent of SINADEO
Any non-authorized use of the website or of a part of its content will be considered as constitutive of a piracy and sued according to the article L.335-2 and following of the French code of intellectual property law.

6. Limitation of responsibilities

SINADEO is not liable of direct or indirect damages caused to the user equipment during the access to the website and resulting either from the usage of a material not complying with the specification mentioned in the paragraph 4, or of the occurrence of a bug or of an incompatibility.
SINADEO is not more liable to any other indirect damages (such as the loss of a market or a commercial opportunity) consecutive to the use of the site.
Some interactive spaces (ie: Possibility to ask questions in the “contact” space) are available to users. SINADEO reserves the right to suppress, without prior notice, any content uploaded in this space which would breach the relevant legislation in France, more particularly the data protection related legal provisions.
Violating these laws can result in civil liability and criminal penalties, particularly in case of any message with racist, abusive, defamatory or pornographic content, regardless of the media used (text, pictures…).

7. Personal data

In France, personal data is notably protected by the law n° 78-87 of January 6th, 1978, the law n° 2004-801 of August 2004, the article L. 226-13 of the penal code and the European directive of October the 24th 1995.
When using the site, the following elements can be collected: the URL address of the links used by the user to access to the website, the Internet Protocol address (IP) of the user.
In any case, the sole purpose of the collection of the user personal data is to provide some services offered by the website. The user provides this information knowingly, particularly when he/she makes the data entry by him/herself. The obligation to supply or not supply this information is then specified to the website user.

In accordance with the articles 38 and following of the data Protection Act, Number 78-17 of January the 6th related to computing, files and privacy, any user has the access, rectification and opposition rights to his/her personal data, by written and signed request, accompanied by a copy of a proof of identity with the owner signature by specifying the appropriate address the answer must be sent back to.
No personal information is published, exchanged, forwarded, ceased or sold on any support to third parties without the consent of the website user. In case of a potential purchase of SINADEO and its rights, the transmission of this information could occur to the benefit of the buyer who would then be required to comply with the same obligations of archiving and modification of this data regarding the user.

The website is not declared to the CNIL because it does not collect any personal information.
The databases are protected by the provisions of the low of July 1st, 1998 transposing the directive of March 11th, 1996 related to the legal protection of databases.

8. Hypertext links and cookies

The website includes several hypertext links toward other sites, implemented with the authorization of SINADEO. However, SINADEO is not in position to check the content of sites thus visited and will not take any responsibility due to such connections.

The website navigation is likely to trigger the installation of cookies on the user computer. A cookie is a small size file, which cannot be used to identify the user but which records information concerning the browsing by a computer on a site. The data thus obtained is intended to facilitate subsequent visits to the site, as well as to enable various measurements of visit frequency.
The refusal of cookies installation may limit the access to some services. However, the user has the possibility to configure its/her computer as follow to refuse the cookies installation:
With the Microsoft internet explorer: Tab tool (click on the wheelwork icon on the top right) / Internet option.
Click on Confidentiality and select: Block all the cookies. Confirm on the Ok button.
With Firefox: Click on the Firefox button on the top of the browser window, then select the tab Options. Click on the privacy tab.
Set the rule of conservation on: “Use the personal parameters for the history”. Then uncheck the box in order to make the cookies inactive.
With Safari: Click on the top right of the browser on the menu icon (represented by a wheelwork). Click on Parameters. Click on “Advanced parameters”. In the “Confidentiality” section, click on the Content parameters; In the section “Cookies”, you can block the cookies.

9. Applicable law and allocation of jurisdiction

Any dispute related to the use of the website is subject to French law and shall be submitted to the exclusive jurisdiction of the relevant Paris Courts.
